US power companies fight back on carbon

A group of US power companies has filed motions in federal court to dismiss a carbon dioxide lawsuit that several states brought against the industry this summer (see News in COSPP September-October 2004). Cinergy Corp., American Electric Power Company Inc., Southern Co., Xcel Energy Inc. and the Tennessee Valley Authority filed motions in the US District Court for the Southern District of New York.

Attorneys general from eight states filed a lawsuit against the five utilities in July, claiming they are among the largest contributors of carbon dioxide. The states asked the court to require the companies to reduce carbon dioxide emissions by at least 3% annually for the next 10 years.

The power companies contend that the matter cannot be resolved in court, and that Congress and the President will have to address it through international dialogue and federal legislation.
