Legal boost for US biomass power development

A favourable ruling from Washington looks set to boost U.S. biomass power development after the U.S. Environmental Protection Agency (EPA) removed so-called “clean biomass” from a list of materials to be regulated as hazardous waste.

Having RCRA apply to biomass could have meant that power generators that burn biomass would be regulated as hazardous waste incinerators.

The EPA’s December draft rule, eagerly sought by biomass developers and U.S. Senators with significant biomass interests in their states, should remove uncertainty about developing power plants that burn biomass, as well as factories that produce wood pellets and other biomass-derived fuel to be burned at those plants.
